This training course provides an overview of the law, gives best management practices and offers an opportunity to tackle current issues in a confidential setting. To anchor the learning, and winning behaviour, the course incorporates case studies and interactive exercises.

Grievance, discipline, and dismissal procedures require employers to follow fair, transparent, and consistent processes, adhering to the CCMA Code of Conduct. This two-day training course will enable participants to manage disciplinary, grievance and dismissal procedures effectively. The emphasis is on the use of a structured approach where positive action and problem-solving are highlighted as a priority. The course will build knowledge, skill and confidence in handling these areas objectively, fairly and appropriately in line with internal policies/procedures, best practice and legal requirements.

Topics Covered Include the Following:

  • Investigations: How to gather evidence fairly before taking formal action.
  • The Disciplinary Hearing: Structuring the meeting and the employee’s right to be accompanied.
  • Dismissal & Sanctions: Differentiating between fair and unfair dismissal and applying appropriate warnings.
  • Grievance Resolution: Managing formal and informal complaints.
  • Appeals: Understanding the legal requirement for an employee to challenge a decision.
  • Right to be Accompanied: Employees have a legal right to bring a union representative or work colleague to any formal disciplinary or grievance hearing.
  • Fair Process: Even if the company has its own rules, they must align with the labour law code, which advises on, for example, conducting investigations, giving employees time to prepare, and acting without unreasonable delay.
  • Confidentiality: Procedures should be kept confidential, and records kept of all meetings.
